Welcome to Whoopy. These Terms of Service ("Terms") govern your access to and use of the website whoopy.ru and the business process automation services provided by Whoopy ("we", "our", or "us"). By accessing or using our Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Whoopy platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the Service.

2. Description of Service

Whoopy is a business process automation platform that enables users to:

• Build and run automated workflows connecting various business tools and platforms.
• Automate content publishing to social media platforms, including TikTok (via TikTok Login Kit, Content Posting API, and Webhooks).
• Integrate with CRMs, project management tools, communication platforms, databases, and other services.
• Automate data collection, transformation, reporting, and notification pipelines.

Whoopy operates as a web-based platform. Where applicable, integrations use official third-party APIs, including TikTok for Developers APIs.

3. Eligibility

You must be at least 18 years old to use our Service. By using Whoopy, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

4. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account at whoopyaitiktok@gmail.com.

5. Third-Party Platform Authorization

When you connect third-party platforms (including TikTok) to Whoopy:

• You authorize Whoopy to access the connected platform within the scope of the permissions you grant.
• You retain full ownership of your accounts and all content on connected platforms.
• You may revoke Whoopy's access at any time through the connected platform's settings or Whoopy's settings.
• Whoopy will only perform actions you have explicitly configured or requested.

TikTok-specific: When connecting your TikTok account, authentication is handled through TikTok Login Kit (OAuth 2.0). We use the Content Posting API to publish content and Webhooks to receive event notifications on your behalf.

6. User Responsibilities

When using Whoopy, you agree to:

• Comply with all applicable laws and regulations.
• Comply with the terms of service and policies of all connected third-party platforms, including TikTok's Terms of Service and Community Guidelines.
• Only publish content you have the legal right to distribute.
• Not use the Service for illegal, harmful, misleading, or infringing activities.
• Not use the Service for spam, harassment, or any form of abuse.
• Not attempt to reverse-engineer, decompile, or interfere with the Service.

7. Content Ownership

You retain all rights to the content you process through Whoopy. By using our Service, you grant us a limited, non-exclusive license to process, temporarily store, and transmit your content solely for the purpose of providing the Service (e.g., posting it to TikTok or other platforms on your behalf). This license terminates when you delete your content or close your account.

8. Prohibited Uses

You may not use Whoopy to:

• Violate any local, state, national, or international law or regulation.
• Publish content that is defamatory, obscene, threatening, or promotes violence or discrimination.
• Distribute malware, viruses, or any harmful software.
• Impersonate any person or entity or misrepresent your affiliation.
• Collect or harvest personal data of other users without consent.
• Engage in any activity that interferes with or disrupts the Service or connected platforms.

9. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any losses resulting from service interruptions.

10. Third-Party Services

Whoopy integrates with third-party services including TikTok and others. We are not responsible for the availability, content, or policies of third-party services. Your use of connected platforms is governed by their respective terms and policies.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

• Whoopy is provided "as is" and "as available" without warranties of any kind, whether express or implied.
• We do not warrant that the Service will be error-free, secure, or uninterrupted.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
• Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Account Termination

We reserve the right to suspend or terminate your account if:

• You violate these Terms or our Privacy Policy.
• You engage in activities that harm the Service, other users, or third parties.
• Your use of the Service violates connected platform policies, resulting in API access restrictions.

You may terminate your account at any time by contacting us at whoopyaitiktok@gmail.com. Upon termination, we will delete your data in accordance with our Privacy Policy.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Russian Federation, without regard to conflict of law principles.
